CityWorks – De Stedenfabriek appreciates the interest you have shown in us by visiting our website, http://www.destedenfabriek.nl or by subscribing to our Service. We’ll start by getting a few definitions out of the way that should help you understand this policy. When we say “we,” “us,” “our,” and “CityWorks – De Stedenfabriek” we’re referring to ANDRS Projects Europe, a Netherlands private limited company, that holds the CityWorks – De Stedenfabriek registered trademark. When we say “you”, “user”, “member” or “owner” we’re referring to the person or entity accessing or using the Service.
We offer the Service on our websites. In the course of providing the Service, we may collect Personal Information. “Personal Information” means any information that identifies or can be used to identify you directly or indirectly, including, but not limited to, first and last name, date of birth, email address, gender, occupation or other demographic information.
SCOPE OF THIS POLICY AND USING OUR SERVICE
INFORMATION WE COLLECT

- Your participation in CityWorks – De Stedenfabriek sweepstakes, contests, or research studies
- Uploads or posts to the Service
- Requests for customer support and technical assistance
Information from and about you: The types of data we collect directly from you may include:
– Name, address, telephone number and email address
– Optional information, such as a photograph, that you elect to associate with your account (your “Profile Information”)
– Log-in details and password, if you create a CityWorks – De Stedenfabriek account
– With your permission, certain information stored on your mobile device
– Any email requests or questions you submit to us
– Demographic information such as your gender
– User-generated content you post on the Service
Information about others: If you choose to use our invitation service to invite a friend to the Service, we will ask you for that person’s email address and automatically send an email invitation. CityWorks – De Stedenfabriek stores this information to send this email, to register your friend if your invitation is accepted, and to track the success of our invitation service.
Content: You also provide us information in Content you post to the Service. Your Content and metadata about your Content may be viewed by other users in accordance with your settings on the Service. CityWorks – De Stedenfabriek can, but has no obligation, to monitor your Content you post on the Service. We can remove any information you post for any reason or no reason. CityWorks – De Stedenfabriek and CityWorks – De Stedenfabriek employees will not view Content that is not made viewable in accordance with your settings on the Service, except: (i) to maintain, provide or improve the Service; (ii) to help you and resolve your support requests; or (iii) as CityWorks – De Stedenfabriek believes, in its sole opinion, is necessary to comply with or avoid the violation of applicable law or regulation or to cooperate with law enforcement.
Payment Information. If you are a user of our paid premium service, we will utilize a third party credit card payment processing company to collect payment information, including your credit card number, billing address and phone number. The third party service provider, and not CityWorks – De Stedenfabriek, stores your payment information on our behalf.
- Information We Automatically Collect
When you use our Service that connect to the Internet, including, but not limited to, when you access the Service via our websites, your mobile devices, and CityWorks – De Stedenfabriek’s Software, we automatically collect certain information as described in this Section. As discussed further below, we and our service providers (which are third party companies that work on our behalf to provide and enhance the Service) use a variety of technologies, including cookies and similar tools, to assist in collecting this information.
Cookies: When you use the Service, we may send one or more “cookies” – a small data file – to your computer to uniquely identify your browser and let CityWorks – De Stedenfabriek help you log in faster and enhance your navigation through the site. A cookie may convey anonymous information about how you browse the Service to us. A persistent cookie remains on your hard drive after you close your browser so that it can be used by your browser on subsequent visits to the Service. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled.
Log Files: When you use the Service, our servers automatically record certain information sent by your web browser. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, mobile carrier, and other such information.
Clear Gifs Information: When you use the Service, we may employ clear gifs (also known as web beacons) which are used to track the online usage patterns. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting and make CityWorks – De Stedenfabriek better for our users.
Geo-Location Information: When you use the Service by or through a mobile device, we may access, collect, monitor and/or remotely store “location data,” which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device. Location data may convey information about how you browse the Service to us. Location data does not collect or share any personally identifiable information about you. Location data may be used in conjunction with personally identifiable information. Some features of the Service, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.
Device Identifiers: When you access the Service by or through a mobile device, we may access, collect, monitor and/or remotely store one or more “device identifiers.” Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device and are used to enhance the Service. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by us. A device identifier may convey information about how you use the Service to us. A device identifier does not collect or share any personally identifiable information about you. A device identifier may be used in conjunction with personally identifiable information. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Service. Some features of the Service may not function properly if use or availability of device identifiers are impaired or disabled. CityWorks – De Stedenfabriek may access, collect and/or store device identifiers upon enabling CityWorks – De Stedenfabriek’s Services.
HOW WE USE & DISCLOSE YOUR INFORMATION
CityWorks – De Stedenfabriek uses information we collect to operate, maintain and provide you the features and functionality of the Service that you have requested, to analyze how the Service is used, diagnose service or technical problems, maintain security, personalize content, remember information to help you efficiently access your account, monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns, and track Content and users as necessary to comply with copyright provisions and other applicable laws. Without your information, we cannot provide you with the Services you have requested or you may be limited in your use of the Services.
- Reasons to use and disclose Personal Information
- To send you informational and promotional content in accordance with your marketing preferences. You can stop receiving our promotional emails by following the unsubscribe instructions included in every email. We may also use your contact information combined with device identifiers to send you in app marketing messages. If you don’t want to receive these messages, you can turn off notification settings on your mobile device.
- To bill and collect money owed to us by our Customers. This includes sending you emails, invoices, receipts, notices of delinquency, and alerting you if we need a different credit card number. We use third parties for secure credit card transaction processing, and we send billing information to those third parties to process your orders and credit card payments.
- To communicate with you about your account and provide customer support.
- To enforce compliance with our Terms of Service and applicable law. This may include developing tools and algorithms that help us prevent violations.
- To protect the rights and safety of our users and third parties, as well as our own.
- To meet legal requirements, Including complying with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms.
- To provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements.
- To prosecute and defend a court, arbitration, or similar legal proceeding.
- To respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.
- To provide, support, and improve the Service we offer. This includes our use of the data that our Customers provide us in order to enable our Customers to use the Service to communicate with their members. This also includes, for example, aggregating information from your use of the Service or visit to our websites and sharing this information with third parties to improve our Service. This might also include sharing your information or the information you provide us about your members with third parties in order to provide and support our Service or to make certain features of the Service available to you. When we do have to share Personal Information with third parties, we take steps to protect your information by requiring these third parties to enter into a contract with us that requires them to use the Personal Information we transfer to them in a manner that is consistent with this policy.
- How we disclose Personal Information
Your Use: We will display your Personal Information in your profile page and elsewhere on the Service according to the preferences you set in your account. Any information you choose to provide should reflect how much you want others to know about you. Please consider carefully what information you disclose in your profile page and your desired level of anonymity. You can review and revise your profile information at any time. We may also share or disclose your information with your consent, for example if you use a third party application to access your account (see below).
Your name, email address and other information you choose to provide on the Service – such as a photograph, that you elect to associate with your account profile – will be viewable and discoverable by other users, in accordance with your settings on the Service.
We may use your email address to send you Service-related notices (including any notices required by law, in lieu of communication by postal mail). We may also use your contact information combined with device identifiers to send you marketing messages. If you don’t want to receive these messages, you can opt out by following the instructions in the message or turn off notification settings on your mobile device. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.
Business Transfers: As we develop our business, we may buy or sell assets or business offerings. Customers, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.
Compliance with Laws and Law Enforcement Requests; Protection of CityWorks – De Stedenfabriek’s Rights: CityWorks – De Stedenfabriek may disclose your personal information if required to do so by law or subpoena or if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect CityWorks – De Stedenfabriek’s rights or property.
Non-Personally Identifiable Information: We may disclose your non-private, aggregated, or otherwise non-personally identifiable information, such as anonymous usage data, platform types, etc., with interested third parties to help them understand the usage patterns for certain CityWorks – De Stedenfabriek Services.
DATA COLLECTED FOR AND BY OUR CUSTOMERS
As you use our Service, you may import into our system Personal Information you have collected from your members. Members of the Service opt in upon accepting your invitation request to the Service and their use of the Service is governed by the Terms. Consistent with the uses of Personal Information, we may transfer Personal Information of you or your members to companies that help us promote, provide, or support our Service or the services of our Customers (“Service Providers”). All Service Providers enter into a contract with us that protects Personal Information and restricts their use of any Personal Information consistent with this policy. As part of our Service, we may use and incorporate into features information you have provided, we have collected from you, or we have collected about members. We may share this information, including member email addresses, with third parties in line with the approved uses.
If you are a member and no longer want to be contacted by one of our Customers you can contact the Customer directly to request to update or delete your Personal Information. If you contact us, we may remove or update your information within a reasonable time and after providing notice to the Customer of your request.
We will retain Personal Information we process on your behalf of on behalf of our Customers for as long as needed to provide our Service or to comply with our legal obligations, resolve disputes, prevent abuse, and enforce our agreements.
PUBLIC INFORMATION AND THIRD PARTY WEBSITES
(a) Challenges or Events. Some areas of the Service allow you to post or upload information, text, graphics, or other material connected to Challenges or Events. When posting Content – such as information about a Challenges or Events as – it may be read, collected, and used by anyone. If your Personal Information appears in relation to Challenges or Events and you want it removed, contact us here. If we are unable to remove your information, we will tell you why.
(b) Social media platforms and widgets. Our Service includes social media features, such as the Facebook Share button. These features may collect information about your IP address and which page you are visiting on our Service, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Service. We also maintain presences on social media platforms including Facebook, Twitter, and Instagram. Any information, communications, or materials you submit to us via a social media platform is done at your own risk without any expectation of privacy. We cannot control the actions of other users of these platforms or the actions of the platforms themselves. Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them.
HOW WE PROTECT YOUR INFORMATION
The security of your information is important to us. When you enter sensitive information (such as a credit card number) as part of our service, we encrypt the transmission of that information using secure socket layer technology (SSL).
CityWorks – De Stedenfabriek uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information, once we receive it. For example, we continuously and regularly back up your data to help prevent data loss and aid in data recovery. We also guard against common web attack vectors, host data in secure ISO9001, ISO27001, and SSAE16 Type II certified data centers of Digital Ocean in Amsterdam, and implement firewalls and access restrictions on our servers to secure our network and better protect your information. No method of electronic transmission of storage is 100% secure, however, and we cannot ensure or warrant the absolute security of any information you transmit or store in the Service.
CityWorks – De Stedenfabriek accounts require a username and password to log in. You must keep your username and password secure, and never disclose it to a third party. Your account passwords are encrypted, which means we cannot see your passwords. We cannot resend forgotten passwords either. We will only reset them.

YOUR CHOICES ABOUT YOUR INFORMATION
You may, of course, decline to submit personally identifiable information through the Service, in which case CityWorks – De Stedenfabriek may not be able to provide certain services to you. You may update or correct your account information at any time by logging in to your account.
– Depending on whether you are using our free services, or are a user of a paid premium account that belongs to you or a Customer, you will have certain choices through your account interface or through your mobile device’s operating system, to opt-out of receiving categories of notices as part of the Service.
CITYWORKS – DE STEDENFABRIEK BLOG & COMMUNITY
Our Service offers publicly accessible community services including blogs, and forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Your posts may remain even after you cancel your account.
Protecting the privacy of young children is especially important. Our Service is not directed to persons under 16. CityWorks – De Stedenfabriek does not knowingly collect or solicit personal information from anyone under the age of 16 or knowingly allow such persons to register with the Service. If we become aware that we have collected personal information from a child under age 16 without verification of parental consent, we take steps to remove that information. INTERNATIONAL DATA TRANSFER
As an international company, we may transfer and access Personal Information from around the world, including between and from within the European Union and the United States. CityWorks – De Stedenfabriek aims to maintains strong data protection and privacy controls to protect your Personal Information and to ensure its security during international transfer and any periods of storage in foreign locations.
THIRD PARTY SERVICES & EU PRIVACY FRAMEWORKS
When we employ other parties to perform functions on our behalf these parties may be located in the EU/EEA or the United States of America (“USA”). Any party employed by us that is located in the USA complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. We may share some of your information with these service providers in order for them to provide their services, analyzing data, providing marketing assistance, conducting customer and/or user profiling, and providing customer service. As such, the terms and privacy policies of these service providers may apply to you as well, in particular: Google Analytics, Google Adwords, Google Tag Manager, Google Recaptcha, Helpscout, MailChimp. Acceptance of these service provider terms is required to access the website and Service. Further information is set out below in our Cookie Statement
We will give an individual, either you or a Member or Owner, access to any Personal Information we hold about them within 30 days of any request for that information. Individuals may request to access, correct, amend or delete information we hold about them by contacting us here. Unless it is prohibited by law, we will remove any Personal Information about an individual, either you or a member, from our servers at your or their request. There is no charge for an individual to access or update their Personal Information.
